These terms govern your use of www.peterbiltpacific.com and its related pages (the “Site”), operated by [Peterbilt Pacific Inc.] (“Peterbilt Pacific”, “we”, “us”), 9515 195 Street, Surrey, BC V4N 4G3. By using the Site you agree to these terms. If you do not agree, please do not use the Site.

1. Information and availability

The Site describes trucks, parts, service, leasing and financing offered by Peterbilt Pacific in British Columbia. Inventory listings are compiled from manufacturer build records and our dealer management system and are provided for general information. Specifications, equipment, mileage, photographs and availability may contain errors or omissions and may change without notice. Every unit is subject to prior sale. Where a photograph is marked as a representative image, it shows the model and not the specific unit offered.

2. Prices

Unless a listing says otherwise, a displayed price is in Canadian dollars and excludes applicable taxes, licensing and registration, and any freight, pre-delivery inspection or optional equipment, which will be quoted before purchase. “Price on request” means a price is available from a sales representative. Prices and specials may change or be withdrawn without notice, and specials are subject to the conditions stated for them.

3. No contract formed online

Nothing on the Site is an offer capable of acceptance. A sale, lease, service appointment, parts order or financing arrangement is concluded only under a written agreement signed by Peterbilt Pacific, or, for service, when the branch confirms the appointment. A financing enquiry submitted through the Site is not a credit application and does not result in a credit check.

4. Your submissions

When you submit a form you confirm the information is accurate and that you are authorized to provide it. We handle personal information as described in our Privacy Policy. You must not submit content that is unlawful, infringing, defamatory or that contains malicious code, and you must not use the Site to send unsolicited messages, scrape data or interfere with its operation.

5. Links sent to you

Some features are reached through links we email to you (for example, to manage a service appointment, a parts request or your newsletter preferences). Those links are personal to you; do not share them. We may disable a link that we believe is being misused.

6. Intellectual property

The Site, its design, text, photographs, software and data are owned by Peterbilt Pacific or its licensors and are protected by Canadian and international copyright and trademark law. Peterbilt, PACCAR, TRP, PacLease and related marks are trademarks of PACCAR Inc, used under licence. Other names and marks belong to their owners. You may view and print Site content for your own evaluation of our products and services; any other reproduction, distribution or commercial use requires our written permission.

7. Third-party sites and services

The Site links to sites and services we do not control, including manufacturer programs, an applicant tracking system and a mapping service. Those sites have their own terms and privacy practices, and we are not responsible for them.

8. Disclaimer and limitation of liability

The Site is provided “as is” without warranty of any kind, express or implied, to the extent permitted by law, including as to accuracy, availability or fitness for a purpose. To the extent permitted by law, Peterbilt Pacific and its affiliates, directors, employees and agents are not liable for any indirect, incidental, special or consequential loss arising from your use of, or reliance on, the Site or its content. Nothing in these terms limits liability that cannot be limited under the laws of British Columbia, and nothing affects the terms of any written agreement you enter into with us.

9. Changes

We may change the Site or these terms at any time; the date above identifies the current version. Continued use after a change means you accept it.

10. Governing law

These terms are governed by the laws of British Columbia and the federal laws of Canada applicable there. You agree that the courts of British Columbia have exclusive jurisdiction over any dispute relating to the Site.
